As the income tax return (ITR) filing season is going on, taxpayers have either filed their ITR or are preparing documents to do it. To file the ITR for FY 2024-25, only 45 days are left, as the last date is September 15. However, there is are chances that you might have made a mistake while filing your return. But, you can revise your ITR under Section 139(5) of the Income Tax Act, 1961. You can refile your ITR for errors like misreported income, missed deductions, or incorrect tax calculations. 

The return should be revised within the prescribed time limit. It can be revised any time three months before the end of the assessment year or before the completion of the assessment, whichever is earlier, according to the Income Tax Department's official website.

Notably, if the original return was filed in paper format or manually, then technically it cannot be revised in online mode or electronically. ​​​

What is the last date to file a revised return?

The deadline to file a revised ITR for FY25 is December 31, 2025, of the assessment year or before the completion of the assessment by income tax authorities, whichever is earlier. You can revise your ITR even if your original ITR has been processed by the Income Tax Department. 

Is there any penalty for a revised ITR?

You don't need to pay a penalty if you have filed your ITR before the due date and also e-verified it within 30 days. However, if you have crossed the deadline, then the I-T Department will treat it as a belated ITR and you will have to pay a fee under Section 234F.

If the ITR wasn’t filed by the due date, the return will be treated as a belated tax return, and the taxpayer will be levied late fees under Section 234F.

What should you keep in mind while filing a revised ITR?

  • A revised return may be submitted if the ITR e-filing form has to be modified.
  • There is no cap on the number of times you can file an amended tax return, so you can do so as often as you like.
  • If you have received a refund after your income tax return has been processed, you can file a revised return as long as you do it by the deadline.
  • If you have filed your ITR under the old tax regime, then you can file a revised return under the old or the new regime, but if you originally filed it under the new tax regime, then you can not switch it to the old regime while filing a revised ITR.
