Prepon was designated as the primary residential parent in the deal but they will share physical and legal custody of their two children.

Foster told the court he had never been arrested for or faced any legal issues related to alcohol. The actor’s lawyer said, “ironically, if anything, [Prepon] is well-known for enjoying her drinks — day and night.

Foster pointed out Prepon was the one who called herself “wine mommy.”

Prior to the settlement, Prepon submitted affidavits from employees detailing Foster’s alleged behavior.

One employee named Laura Vogel wrote, “Ben has shown, predominantly through inaction and absence, that being a father is not Ben’s priority. Sadly, Ben has never prioritized caring for the parties’ children.”

Vogel added, “When Ben did ‘pop in’ he would often be drinking alcohol.”

Emily Neikman, another employee, wrote, “A more serious concern that I have about Ben’s ability to care for these children relates to his consumption of alcohol around the children. It is my opinion that Ben has an issue with alcohol that needs to be addressed. I have frequently found whiskey in coffee cups that Ben leaves in the children’s rooms.”

Foster scoffed at the claims. His attorney told In Touch at the time, “Laura Prepon’s filing is the definition of falsehood and a disturbing fiction.”

Prepon became a household name during her run as Donna Pinciotti in the Fox sitcom That 70’s Show, which ran from 1998 to 2006. She recently reprised her role in Netflix’s sequel That 90’s Show, which ran for two seasons from 2023 to 2024.
