Jay Cutler Sued By the Driver He Hit During 2024 DUI

Jay Cutler was hit with a lawsuit over his 2024 DUI only days after he learned he would serve four days in jail over the arrest, Us Weekly can exclusively report.

On Tuesday, September 2, Perry Lee, who was the driver of the car Cutler crashed his vehicle into while intoxicated, filed a lawsuit against the ex-NFL star.

In the suit, obtained by Us, Lee said Cutler was “at fault for the collision.” He said Cutler, 42, followed his car at an unsafe distance, failed to maintain proper lookout and failed to pay attention.

Lee’s suit read, “Cutler failed to use reasonable and due care in the operation of the vehicle he was driving so as to avoid injury to other persons using the roadway, including [Lee].” Lee’s lawyers point out that Cutler was intoxicated during the crash.

Lee said he has incurred medical bills and other expenses as a result of the crash. In addition, he said he has endured physical and mental suffering and the loss of enjoyment of life. His lawsuit demanded unspecified damages.

Lee’s lawyers, Morgan & Morgan founder John Morgan and attorney Sydney Pierce, tell Us, “Our client is a veteran who was injured in a car crash due to the alleged negligence of another driver.”

They added, “His injuries from the crash cause him daily pain and have eroded his quality of life. We are seeking justice for him so he can get the care he needs and try to move forward with his life.”

As Us previously reported on August 26, a Tennessee judge ordered Cutler to serve time at the Williamson County jail, attend DUI classes and pay $350 in fines.

The athlete will have his license revoked for a period of time and will serve one year of unsupervised probation after his release from jail.

Cutler was arrested on October 17, 2024, after allegedly rear-ending another vehicle. The driver of the other car told police the former NFL star offered him $2,000 in an attempt to convince him not to call the police.

A report by officers noted Cutler was “staggering, swaying and heavy-footed while walking” while they were on scene. They said he had “bloodshot” and “watery” eyes. He denied having any drinks before driving, according to the report.

When asked a second time whether he had anything to drink earlier in the day, Cutler told an officer, “a little bit.”

Cutler refused to perform a field sobriety test. The officers took him to the hospital to draw a blood sample. During a search of his car, the police found a “loaded Glock handgun” inside. He was booked on charges of DUI, illegally possessing a weapon while intoxicated and failure to exercise due care to avoid a collision. He was released after posting bonds.

As part of a deal with prosecutors, Cutler pleaded guilty to one count of misdemeanor DUI and the other charges were dropped.

Cutler will begin his jail sentence on September 29.

As previously reported, Cutler and his girlfriend, Samantha Robertson, got engaged in November 2024 after more than one year of dating.

Cutler was previously married to Kristin Cavallari from 2013 until their 2020 divorce. The exes share three children: Camden, 13, Jaxon, 11, and Saylor, 9.
